The time limit for entering the PCT national phase in Brazil is 30 months from the date of priority. The deadline may be restored by the term of 60 days if legitimate reasons are provided.

Reinstatement of rights may be requested where the applicant failed to file application for entry into Brazil National Phase within the applicable time limit, unintentionally or in spite of due care required by the circumstances having been taken. The request shall be submitted within two months from the removal of the cause of the failure to observe the time limit or 12 months from the date of expiration of the applicable time limit, whichever time limit expires earlier.

Amendments to the description, claims and drawings may be made in the national phase for the purpose of clarifying or restricting the application or correcting obvious typographical errors, until request for examination is filed or during the examination procedure for remedying any defect pointed out by the Patent Office, provided that the scope of the subject matter of the application is not broadened thereby.

Annual fees are payable within three months from the second and each subsequent anniversary of the international filing date. If the three-month period ends before the expiration of the time limit applicable for entering the national phase, payment of the first annual fee may be made within three months after the expiration of that time limit. Payment can still be made in extraordinary term during six months after the expiration of the three-month period.

An applicant may request prioritized examination of an application whenever: the applicant is over sixty years of age, handicapped, has serious illness, a startup, scientific or innovation institution, small business; grant of the patent is a condition for obtaining funding; claims in the application may be infringed or may infringe a granted patent; claimed matter concerns green technologies or technology for health treatment or of public interest.

PCT applications may also be protected as Utility Models in Brazil, which are subject to formal and substantive examination. Processes, methods, systems or chemistry compositions are not protectable. The maximum protection period of a utility model in Brazil is 15 years from the filing date. Only a single independent claim is permitted for Utility Models in Brazil, and there is no limit to the number of dependent claims.
